PETITION FOR DETERMINATION OF HEIRS
TO THE HEIRS AT LAW OF GLENNETH N. FILLINGAME, DECEASED and THE HONORABLE CHANCERY COURT OF LAMAR COUNTY, MISSISSIPPI:
COMES NOW, PETITIONER, ROXANE PACE, Administratrix, by and through her attorney, Hon. Joey Fillingane, for the Estate of Glenneth N. Fillingame, Deceased, and files this, her Petition for Determination of Heirs, against all heirs-at-law of Glenneth N. Fillingame, Deceased, and in support hereto, would respectfully show unto this Court the following facts, to-wit:
I.
The Decedent, Glenneth N. Fillingame, departed this life intestate on March 6, 2020, having at the time of his death a fixed place of residence in and being an adult resident citizen of Lamar County, Mississippi.
II.
Petitioners would show that the Decedent is survived by:
Mark Glenneth Fillingame -1084 Carter Circle, Purvis, MS 39475 (Son)
III.
The names of other heirs, if any, of Glenneth N. Fillingame, Deceased, are unknown to the Petitioner after diligent search and inquiry.
IV.
Petitioner would show unto the Court that it would be in the best interests of this Estate for a formal determination to be made of the heirs-at-law of Glenneth N. Fillingame, Deceased, whose names, and street addresses are unknown to the Petitioner after diligent search and inquiry, should be made party defendants to these proceedings by service of process by publication pursuant to the provisions of Rules 81 and 4(c)(4) of the Mississippi Rules of Civil Procedure, and further, Section 91-1-29 of the Mississippi Code of 1972, as amended.
WHEREFORE, THE PREMISES CONSIDERED, the Petitioner, Roxane Pace, of the Estate of Glenneth N. Fillingame, Deceased, prays that her Petition be received and filed, and that process be had upon all other heirs-at-law of Glenneth N. Fillingame, Deceased, by publication, as provided by law, commanding such heirs-at-law of Glenneth N. Fillingame, Deceased, to answer this Petition in the time and manner prescribed by law, and to be and appear before this Court on Monday, July 20, 2020; at 9:00 a.m., in the Lamar County Chancery Courthouse in Purvis, Mississippi; then and there to show, if any can, why the relief requested in the Petition to Determine Heirship of Glenneth N. Fillingame, Deceased, should not be granted; and that upon a final hearing hereof, this Court will enter its Judgment recognizing and adjudicating the above named heirs:
Mark Glenneth Fillingame -1084 Carter Circle, Purvis, MS 39475 (Son)
together with any other heirs-at-law found and to be determined as such, to be the sole and only heirs-at-law of Glenneth N. Fillingame, Deceased.
And, Petitioner prays for such other, general and specific relief to which they may be entitled to in equity and good conscience.
