WHEREAS, on August 28, 2009, Linda Kaye Virgil and Charles Virgil, wife and husband, with rights of survivorship executed a certain deed of trust to Verdugo Trustee Service Corporation, Trustee for the benefit of Citicorp Trust Bank, FSB which deed of trust is of record in the office of the Chancery Clerk of Lamar County, State of Mississippi in Book 1188 at Page 685; and
WHEREAS, DLJ Mortgage Capital, Inc. has heretofore substituted Shapiro & Brown, LLC as Trustee by instrument dated December 10, 2019 and recorded in the aforesaid Chancery Clerk's Office in Book 1784 Page 93; and
WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said deed of trust, DLJ Mortgage Capital, Inc., the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, Shapiro & Brown, LLC, Substituted Trustee in said deed of trust, will on July 14, 2020 offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the East Front Door of the Chancery Court Building of Lamar County, located at 403 Main Street, Purvis, MS 39475, to the highest and best bidder for cash or certified funds the following described property situated in Lamar County, State of Mississippi, to-wit:
All that parcel of land in Lamar County, State of Mississippi, as described in Deed Book 12-N, Page 46, ID# 11901, being known and designated as: Lot 3, Villa Del Rey, Lamar County, Mississippi filed in Plat Book 12-N, Page 46, recorded 11/14/1996.
By fee simple deed from Roy K. Smith and Gloria B. Mitchell Smith, husband and wife as set forth in Deed Book 12-N, Page 46 dated 11/12/1996 and recorded 11/14/1996, Lamar County Records, State of Mississippi.
I WILL CONVEY only such title as vested in me as Substituted Trustee.
