SUBSTITUTE TRUSTEE’S NOTICE OF FORECLOSURE SALE
WHEREAS, a Deed of Trust was executed by Wesley M. Breland to Lillous Ann Shoemaker, Trustee for Magnolia State Bank, which Deed of Trust is recorded in the Office of the Chancery Clerk of Forrest County, Mississippi, in Mortgage Book 2241 at Page 679; and, WHEREAS, the beneficiary has substituted Paul David Walley, Jr. as its trustee in the place and stead of the original trustee, or any substituted trustee, in that certain Substitution of Trustee recorded at Mortgage Book 2302, page 630 and,
WHEREAS, default having been made in the payment of the indebtedness as secured by said Deed of Trust, the legal holder of the notes secured by said Deed of Trust has requested the undersigned to sell said property for the purpose of satisfying the indebtedness and cost of sale; and, NOW, THEREFORE, Paul David Walley, Jr., being the trustee as aforesaid, does hereby give notice that on Friday, the 18th day of September, 2020, within legal hours of sale, being between 11:00 A.M. and 4:00 P.M., will proceed to sell at public auction outcry to the highest bidder for cash at the Northeast front door of the Paul B. Johnson Chancery Courthouse of Forrest County, Mississippi, at Hattiesburg, Mississippi, the following described property located in Forrest County, State of Mississippi, which said property is described in and conveyed by the aforesaid deed of trust to-wit:
Section 31: The West One Half of the S ½ of the NW ¼ of Section 31, T5N, R14W, in the County of Forrest, State of Mississippi, together will all improvements thereon and appurtenances thereunto belonging. AND ALSO, an easement for ingress and egress over, on and along the following described real property, to-wit: Beginning at the Southeast corner of the above described Southwest Quarter of the Northwest Quarter of said Section 31 and run North 30 feet; thence run East to the centerline of the Lavelle Graves Road; thence run Southwesterly along the centerline of the road to the Southern boundary of the Southeast Quarter of the Northwest Quarter (SE ¼ of the NW ¼ ); thence run West along said Southern boundary of the SE ¼ of the NW ¼ back to the Point of Beginning. Title to said property is presumed to be good, but only such title as is vested in the Trustee will be conveyed. The aforesaid property will be sold and conveyed without covenants of representation or warranty, and subject to taxes, if any, which may be outstanding against same. Johnson Chancery Courthouse of Forrest County, Mississippi, in Hattiesburg, Mississippi.
