SUBSTITUTE TRUSTEE’S
NOTICE OF SALE
WHEREAS, on the 19th day of January, 2017, James C. Overstreet executed a Deed of Trust to Nicole T. Lewellyn, Trustee for the benefit of PriorityOne Bank, said Deed of Trust is recorded in Deed of Trust Book 1613 at Page 108 in the Office of the Chancery Clerk of Lamar County, Mississippi;
WHEREAS, the aforesaid PriorityOne Bank, the holder of said Deed of Trust and the promissory note secured thereby, substituted Derek A. Henderson as Trustee therein as authorized by the terms thereof, by instrument dated November 7, 2019 and recorded November 15, 2019, in the Office of the Chancery Clerk of Lamar County, Mississippi, in Deed of Trust Book 1768 at Page 145;
WHEREAS, default having been made in the terms and conditions of said Deed of Trust recorded in Deed of Trust Book 1613 at Page 108 and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said Deed of Trust, and the legal holder of said indebtedness, PriorityOne Bank, having requested the undersigned Trustee to execute the trust and said Deed of Trust for the purpose of raising the sums due thereunder together with attorney’s fees, Trustee’s fees and expenses of sale; and
NOW, THEREFORE, I, DEREK A. HENDERSON, TRUSTEE, in said Deed of Trust, will on the 24th day of July, 2020, offer for sale and will sell at public outcry, to the highest bidder for cash, within the legal hours (being the hours of 11:00 a.m. and 4:00 p.m.) at the East Front Door of the William J. Gamble, III Chancery Building, at Purvis, Mississippi, the following described property situated and lying in Lamar County, Mississippi, to-wit:
The North 30.00 feet of Lot 22, Block A, and a portion of Lot 21, Block A, Foxboro Heights Subdivision, Lamar County, Mississippi, more particularly described as beginning at a point 30.00 feet South of the Northeast corner of Lot 22 and run North for 95.00 feet; thence run South 67° 16' 08"" West for 125.75 feet to the right-of-way of Fox Run Drive; thence run Southwesterly along a curve having a radius of 50.00 feet and a chord distance of 47.00 feet to a point 126.22 feet West of the point of beginning; thence run East and parallel with the North line of Lot 22 for 126.22 feet back to the point of beginning, said parcel is part of Lot 21 and 22, Block A, Foxboro Heights Subdivision, Lamar County, Mississippi.
Commonly known as 197 Fox Run Drive, Hattiesburg, MS 39402.
I WILL CONVEY ONLY such title as is vested in me as Substituted Trustee without warranty whether expressed or implied.
